I have a home insurance with Fire warranty and it shows that I am cover for smoke damage caused by fire. Well, I have several units of the house damaged by the smoke of a fire that occurred in another floor of my building and through the patio lights damaged my house.
Can I give claim against my Insurance Co. or Do I have to claim to the responsible of the fire, which I think is uninsured?

Of course you can claim against your Insurance Co. This is an incident ofsmoke damage caused by fire and for incident we understand `any damage caused by a sudden, accidental and unforeseen event, occurred within the terms of the policy, which consequences are fully or partially covered´
In this case you have suffered a loss corresponding to these features, so your Insurance Co. must attend you and then claim against the responsible of the damage, but that is a step that it is up to the insurance Co.
