Foro seguro de hogar: fuga de agua comenzó antes de que yo contratará la poliza pero se manifiesta después
- Nov 18, 2014
Hello, on 1st of November the plaster ceiling of one room in my house suddenly felt. The assessor from the Home insurance I have contracted came and told me that there was a small leak in a pipe that is on the top floor of the house, which is hidden and the water has been falling gradually into the plaster ceiling soaking it until it felt. I told him that the roof had no signs of damp and he told me it was normal, since it is a thick roof so the plaster absorbs the water until it collapses under its own weight
He told me that for the amount of water absorbed the incident started at least a month ago and as I contracted the insurance on 25th of October it does not cover me for anything, because the incident occurred before I contracted the policy.
Is he right? Is there anything I can do?
Thanks a lot.

You should claim on your Insurance Co. and if they do not assist you eventually, you should make a formal claim against them since they are not right.
The existence of a loss due to water is what is called a “continuing disaster” and the date when the water leak takes place officially is the day when the damage is manifested, so it is impossible to determine the exact date when the pipe got broken and besides there were no damp signs on the ceiling of your room
Therefore, as you were not acting in bad faith, the date of the claim would be after the date of effect of the policy so the Insurance Company must repair the damage produced and to repair the pipe.
I hope this helps.
