Buenas tardes. En la Comunidad de Propietarios en la que resido quieren instalar un ascensor que no cumple las medidas mínimas necesarias en la cabina, y la rampa para acceder a él tampoco cumple la normativa. Es un tema que se va a tratar en la próxima Junta, por lo que me gustaría saber si me puedo oponer a la instalación y, en su caso, negarme a pagar la misma.

Usted, como propietario, puede manifestar en la Junta su oposición al acuerdo, indicando claramente que desea salvar su voto y que solicita que todo ello conste en Acta, para poder impugnar el acuerdo. Si no quiere que se instale el ascensor, deberá acudir al juzgado para impugnar el acuerdo, por aprobar una obra que incumple la normativa.

You, as owner, can oppose on the Board the agreement, clearly indicating that you wish to save your vote and requesting that it recorded in the minutes, to be able to challenge the agreement. If not wants that is install the elevator, must go to the judged to challenge the agreement, by approve a work that violates the normative.
