Pregunta al Administrador de Fincas: El Secretario-Administrador de mi comunidad no refleja en el acta la realidad de los acuerdos

Good morning. I would like to bring up a problem that we are experiencing in our community and is making me confused. The secretary administrator is not reflecting in the Minutes a loyal record of the agreements of the meetings, despite the enquiry of our president asking him to do it properly. He just write his explanations or opinions, mentioned or not at the venue. What can be done? Shall the President sign the minutes?

Good morning. The Secretary-Administrator is who shall edit the Minutes. The Art. 19.2, point f of the Horizontal Property Law say regarding the Minutes that it will include the agreements, naming, when necessary for the understanding of the agreement, the names of the owners who voted in favour and those who voted against, and also their participation coefficient. Therefore, the Minutes don´t need to contain more than that. If something not mentioned in the meeting is included, it shouldn’t be signed till its amendment. If the Administrator is reluctant to amend that, you shall consider removing him.
