Pregunta al Administrador: CLAUSULA SUELO

He recibido una notificación advirtiéndome que puedo reclamar a mi banco la devolución de lo que he estado pagando de más por algo así como una clausula suelo.  ¿Podrían decirme por qué puedo ahora reclamarla y por qué desde 2013?

Ciertamente su pregunta abre un interesante debate sobre temas de derecho, uso/costumbre  y jurisprudencia.  Para facilitarle el dato que realmente le permita ver con claridad la situación, me limito a trasladarle un hecho local

La Audiencia Provincial de Murcia, revocando la sentencia de Primera Instancia, declaró  la nulidad de la cláusula suelo condenando a Banco Castilla-La Mancha a la devolución de 7.000 euros pagados de forma indebida por el cliente.   Además la nulidad de la cláusula implica la devolución de cantidades a los hipotecados.

Y es así, pues el artículo 1303 del Código Civil dice: “Declarada la nulidad de una obligación, los contratantes deben restituirse recíprocamente las cosas que hubiesen sido materia del contrato, con sus frutos, y el precio con los intereses”.

La sentencia recogió que  “el perjuicio consiste en que en el supuesto de bajada del tipo de interés no se produce beneficio alguno para el actor, que estaría obligado a pagar como mínimo un 4% de interés anual. Y la aplicación real de la cláusula suelo – techo  pone de manifiesto que Caja de Ahorros de Castilla – La Mancha, hoy Banco de Castilla La Mancha, S.A., ha actuado en contra de las exigencias de la buena fe, quebrantando la relación de confianza del cliente porque bajo la aparente y formal reciprocidad se encubre una situación ventajosa únicamente para la entidad, máxime si tenemos en cuenta que ésta conoce mejor, al disponer de mayor información financiera, cuál va a ser la evolución futura del Euríbor”.

I have received a notice warning me that I can claim my Bank refund of what they have been overcharging for something called floor clausel.  Could you tell me why I can now claim it and why from 2013?

Certainly your question opens an interesting speech on issues of law, use/custom and jurisprudence.  To provide the data that actually allows you to see clearly the situation, I shall forward you with a local event

The Provincial Audiency of Murcia, reversing the judgment of first instance, declared the invalidity of the clause floor condemning Bank Castilla – La Mancha to the return of 7,000 euros paid unduly by the customer.   Furthermore the invalidity of the clause means the return of amounts to the mortgage.

By the way, art. 1303 of Civil Code states: “Once the nullity of an obligation is confirmed, the contracting parties must return each other things that had been matters of contract, with its fruits, and the price with interest”.

 

The sentence states that “injury consists of that fall in the interest rate if there is any benefit for the actor, who would be required to pay a minimum 4% annual interest. Application and actual clause floor –  shows that today Bank of Castilla La Mancha, S.A., Caja de Ahorros de Castilla – La Mancha, has acted against the requirements of good faith, violating the trust of customer relationship because under the apparent formal reciprocity is concealing a situation advantageous only for the entity”, especially if we take into account that it knows better, the availability of financial information, what will be the future evolution of the Euribor”.
