Buenos días. Resido en un primer piso de un edificio de Orihuela con 7 alturas en el que todos las viviendas estamos conectadas a una calefacción central. Como ustedes sabrán, este invierno no ha sido especialmente frío por lo que ha habido días en los que se ha conectado la calefacción y, literalmente, hemos tenido que abrir las ventanas del calor que hacía (recordar que vivo en un primero y el efecto de la caldera es mucho mayor que en el séptimo piso), lo cual consideramos un gasto inútil pues nosotros no necesitábamos tener la calefacción encendida. Por ello, estamos valorando la posibilidad de adquirir un “Split” que lleve incorporado el aire acondicionado y la calefacción, pero antes de hacer nada necesito saber si he de solicitar permiso a la Comunidad y cómo hacerlo.

Buenos días. El problema que nos plantea es algo muy frecuente en edificios que disponen de un sistema de calefacción central, pero antes de adoptar ninguna decisión hemos de hacer hincapié en una cuestión importante a tener en cuenta. En primer lugar, hemos de saber si lo que usted quiere es elegir otro tipo de servicio para su vivienda o por el contrario quiere cambiar de aprovisionamiento energético en toda la Comunidad. En el primer caso, usted puede elegir sin problema alguno el tipo de servicio que quiere utilizar. No obstante, si usted adquiere el Split le recomendamos que cierre las llaves del contador de su vivienda y se lo comunique a la Comunidad, pues si bien ya no tendrá que hacer frente a gastos de consumo individuales, sí deberá seguir haciendo frente a los gastos de mantenimiento de la caldera, al ser un servicio común. Si lo que quiere es cambiar el tipo de aprovisionamiento, necesita tratarlo en la Junta y que sea aprobado por las 3/5 partes de los vecinos y las 3/5 partes de las cuotas de participación, en virtud del artículo 17.4 de la LPH.

As you know, last winter has not been especially cold so there have been days where heating is connected and, literally, we had to open the windows of the heat making (remember that I live in a first and the effect of the caldera is much larger that on the seventh floor), which we consider a useless expenditure because we needed not to have the heating on. For this reason, we are assessing the possibility of purchasing a “Split” that carry built-in air conditioning and heating, but before you do anything I need to know if I have to apply for permission to the community and how to do it.
