En mi comunidad tenemos dos porteros que se turnan para hacer un servicio de 24 horas. En lo que pagamos de comunidad se incluye este servicio, y una de las tareas que tienen los porteros es la recogida de basura. Pues bien, recientemente los porteros están mandando cartas a todos los vecinos diciendo que sólo recogerán la basura de cada vivienda si se les paga 10 euros mensuales, es decir, como si fuera un servicio distinto y adicional. ¿Es esto legal y se debe pagar?

Buenos días. Por lo que entiendo, se trata de una decisión unilateral de los porteros para incrementar su remuneración. Sin embargo, dicha decisión no tiene efecto alguno, no pueden exigir 10 euros más para recoger la basura si dicha función ya les está encomendada, y mucho menos exigir dicho incremento sin haberse adoptado esta decisión por las vías legales para ello. Por lo que le recomiendo que contacte con su Presidente para que tome las medidas oportunas, comunicando al resto de vecinos que ninguno está en la obligación de pagar esto, y en todo caso, si ambos porteros se niegan a la recogida como hasta ahora se hacía, habrá que considerar un despido por no cumplir debidamente con su trabajo.

In my community there are two caretakers rendering 24 hours of doorman service. The contract includes the waste collection. Recently, the neighbours have received a notification signed by the caretakers, informing that they will only collect the bags if the owner pays 10€ a month. Shall we pay? Is this legal?

Good morning. Apparently, your commissionaires are trying to get an increase in the salary without negotiation. They cannot oblig to the owners to pay separate for the waste collection if this has not been agreed by the community in a general meeting of owners. You should speak with your president encouraging him to send a notification for all owners warning that this is not right and that they should not pay extra since it is part of the ocntract. Speak with he commissionaires and make them understand that if they do not fulfill the work, you can terminate the contract.
