Hace unas semanas y sospechando de la mala gestión y organización de la Comunidad, revise varías Actas en donde pude comprobar que se hay varios acuerdos que se adoptaron y aprobaron de forma extemporánea sin que figurasen en el orden del día, cosa que dudo mucho que sea conforme a la Ley. ¿Es esto legal?, en caso de no ser correcto, ¿puedo impugnarlos?

En base a lo que nos manifiesta, los acuerdos sobre asuntos que no aparecen en el orden del día sobre los asuntos a tratar no serán válidos, y ello según lo dispuesto en el artículo 16.2 de la Ley de Propiedad Horizontal. Por tanto la nulidad se podrá decretar únicamente sobre el acuerdo adoptado que no apareciera en el orden del día, siendo el resto de acuerdos que se hubieran podido tratar válidos. Eso sí, tendrá que tener en cuenta el plazo de caducidad para impugnarlo que es de un año por haber sido adoptado en contra de lo establecido en la Ley.

A few weeks ago and suspecting bad management and organization of the community, I reviewed several records where I could check several agreements that were adopted and approved of extemporaneous form without that were in the order of the day, something that I very much doubt that it is in accordance with the law. Is this legal?, if not correct, can challenge them?

Based on what you manifest, the agreements on matters that do not appear on the agenda on the issues to be treated will not be valid, and that pursuant to article 16.2 of the Horizontal property law. Therefore the nullity can only be on the adopted agreement not included in the agenda, being the rest of agreements which had been able to be valid. Now, take into account that the expiration time to challenge it is a year for having been adopted against the provisions of the law.
