Buenos días. La comunidad en la que resido no se encuentra constituida formalmente, pero hace unos días se comunicó verbalmente a todos los vecinos que la forman que era necesaria la reparación del tejado pues, como consecuencia de las lluvias acaecidas días atrás, se estaban inundando dos viviendas. La respuesta de varios de ellos fue que se niegan a dicha reparación por lo que no están obligados a pagar su cuota correspondiente. ¿Es esto correcto?

Los vecinos que se niegan a abonar la reparación están equivocados. Aunque la Comunidad no esté constituida formalmente, existe y, como tal, se rige por la Ley de Propiedad Horizontal. Según dicho texto legal, existe la obligación de mantener el edificio en las adecuadas condiciones de conservación, seguridad, habitabilidad, etc… Y, por la misma ley, también existe la obligación de contribuir a los gastos de acuerdo al sistema establecido (según coeficientes, por normal general, o a partes iguales, en algunas Comunidades). Por tanto, procedan a su reparación y posteriormente exijan los importes según el procedimiento referido. No se pueden negar y en caso contrario se puede actuar contra ellos.

Good morning. The community where I live is not formally constituted. Recently, the owners have been informed verbally that the roof needs some repairs due to filtrations causing flooding in two apartments. Some of the neighbours said they are not paying for that and that they are not obliged. Is that right?

The neighbours refusing to pay are wrong. The community is ruled by the Horizontal Propiertors Law although it is not constituted. According to that law, the owners of the same community are obliged to share the maintenance costs needed for safe and inhability (usually with the criteria of the coefficients, in some cases, in equal proportions) So, non payment is not an option. And if they do not pay, the neighbours can take legal actions.
