Recientemente he comprado una vivienda en Murcia. Dicha vivienda es un bajo con un patio interior al que sólo se puede acceder desde mi vivienda. En dicho patio hay colocados a ras del suelo varios aparatos de aire acondicionado de otros vecinos que ocupan mucho espacio, genera suciedad y además hacen un molesto ruido. ¿puedo quitarlos de mi patio?

Buenos días. Según nos comenta, usted debe saber que dicho patio no es suyo, es un elemento común del que seguramente usted tiene asignado el uso y disfrute, no obstante lo primero que habría que hacer es revisar las escrituras para ver si usted tiene asignado ese uso y disfrute de manera exclusiva; si es así y salvo que exista un acuerdo de la Junta de propietarios autorizando la instalación en el patio, usted estaría perfectamente legitimado para solicitar su retirada, pues estaría obstaculizando dicha ocupación su derecho a ese uso y disfrute que le pudiera corresponder.

I recently purchased a home in Murcia. It is a groundfloor with an interior patio that can only be accessed from my house. In the patio, there are several air conditioning units from other neighbors which occupy too much space, generate dirt and also make an annoying noise. Can I remove them from my patio?

Good morning, you should know that the patio is not yours, it is a common element which surely you have assigned in the title deed the use and enjoyment, however the first thing that should be done is to check the deeds to see if you have exclusive rights; If so, and unless there is an agreement of the Board of owners authorizing the installation in the courtyard, you would be perfectly entitled to request their withdrawal, because it would be obstructing such occupation their right to such use and enjoyment that may correspond.
