En el mes de Junio remití un escrito tanto al presidente como al administrador de mí Comunidad en el que solicitaba incluir un punto que me interesaba en el orden del día. La respuesta de ambos fue que esa cuestión se debería tratar en Junta Ordinaria. Pues bien, en ese mismo mes y unos días después de mí propuesta, surgió la posibilidad de realizar una prueba deportiva en la finca y ambos convocaron una Junta Extraordinaria con este único punto. ¿Tiene potestad para decidir qué puntos se incluyen en las Juntas Extraordinarias o debería haber incluido también el mío?.

Cualquier propietario tiene derecho a solicitar que un determinado asunto sea incluido en el orden del día de una reunión, tal y como establece el artículo 16.2 de la LPH “Cualquier propietario podrá pedir que la Junta de propietarios estudie y se pronuncie sobre cualquier tema de interés para la comunidad; a tal efecto dirigirá escrito, en el que especifique claramente los asuntos que pide sean tratados, al presidente, el cual los incluirá en el orden del día de la siguiente Junta que se celebre.”

Good afternoon. In the month of June, I sent one letter to the President and to the administrator of my community in which I requested to include a point in the agenda. The answer from both was that it should be handled in General Meeting. As well, in the same month and a few days after I proposed, emerged the possibility of making a sports event on the community and both convened an extraordinary meeting with this single point. Have they the power to decide which items are included in extraordinary meetings or should they have also included mine?.

Any owner has the right to request that a particular matter is included in the agenda of a meeting, as established in article 16.2 of the LPH “any owner may request that the Board of owners consider and speak on any topic of interest to the community; for this purpose it will be written, specifying clearly the ítems to be included by the President, which will include them in the agenda of the next meeting to be held.”
