En mi Comunidad se ha planteado vender a un particular la buhardilla en la que vivía el anterior portero del edificio, sin embargo tenemos dudas sobre la posibilidad de ello, ¿podría informarnos de cómo proceder en este sentido?

Tratándose de un elemento común del edificio lo primero que necesitan para realizar el cambio de su naturaleza es el acuerdo unánime de todos los propietarios en Junta, en donde se deberá reflejar dicho cambio, las alteraciones que suponga en la descripción de la finca y la variación en las cuotas.
Posteriormente, todos estos detalles del acuerdo, que se recogerán en acta, serán elevados a escritura pública de lo que se encargará el Presidente en representación de la comunidad, para proceder a su inscripción en el Registro de la Propiedad y proceder al cambio del título constitutivo, haciendo constar la conversión del elemento común en elemento privativo, y a partir de ahí poder hacer efectiva la venta.
