Buenos días. En la última junta de propietarios se aprobó la realización de unas obras para eliminar los ruidos de mi piso. Para ello, los técnicos de la obra necesitan entrar en el piso de abajo, pero la vecina propietaria se niega a permitir el paso a los operarios. ¿Qué puedo hacer?

La Ley de Propiedad Horizontal obliga a los propietarios de todos los pisos que conforman la Comunidad de vecinos a facilitar el acceso a sus viviendas a fin de efectuar las obras o reparaciones que sean necesarias en el inmueble. En consecuencia, si la propietaria del piso de abajo no permite este acceso, sepa usted que esta actuación es del todo contraria a lo dispuesto en la ley y por tanto si así fuera, le recomiendo que acuda a la vía judicial a interponer la correspondiente demanda.

The Horizontal property law requires owners of all apartments comprising the community of neighbours to facilitate access to their homes in order to carry out the works or repairs that are necessary in the building. As a result, if the owner of the ground floor does not allow this access, you are aware that this action is entirely contrary to the provisions of the law and therefore if this were, I recommend that you go to the courts to bring the corresponding action.
