Buenas tardes. Actualmente soy el presidente de una Comunidad de Propietarios, en la que tras analizar toda la documentación a mí alcance he observado que, en lo referentes a las cuentas, el anterior presidente había sustraído 2.300.- € de los fondos de los que dispone la Comunidad. Me gustaría saber que puedo hacer para que devuelva el dinero, intentando por todos los medios que la situación sea lo menos gravosa y violenta para ambas partes.

Lo primero que te aconsejamos es que te cerciores a ciencia cierta de esta afirmación. Una vez verificada la situación, deberás convocar una Junta Extraordinaria, siguiendo los trámites procedimentales oportunos, recogiendo en la convocatoria que uno de los puntos del Orden del Día a tratar será “El descuadre de la cuentas de la Comunidad durante la anterior presidencia, así como el estudio de las posibles medidas a tomar”, ya que deberás aportar en Junta toda la documentación de la que dispongas al objeto de acreditar la producción de los hechos comentados, todo ello con el fin de acordar las posibles medidas que podáis llevar a cabo.
En este tipo de asuntos lo cierto es que si el anterior Presidente no asume los hechos, será la vía judicial la única vía posible para intentar recobrar el dinero sustraído. Una opción sería llegar a un acuerdo en virtud del cual el anterior Presidente se comprometa a abonar la cantidad debida en un plazo determinado (incluso fraccionando el mismo) y, en el caso que no cumpla lo acordado, poner el asunto en manos de un abogado para defender a la Comunidad e iniciar un procedimiento judicial.

The first thing we recommend is that you for sure v. this statement. Once verified the situation, you will have to convene an extraordinary meeting, following the appropriate procedural steps, collecting in the announcement that one of the points of the agenda to deal will be “The crookedness of the accounts of the community during the previous Presidency,” as well as the study of possible measures to take, since you must bring on board all documentation that you have in order to prove the production of the mentioned facts all this in order to agree on possible actions that you can perform.
On this kind of issue it is that if the previous President does not assume facts, will be judicially the only way possible to try to recover the stolen money. One option would be to reach an agreement under which the former President undertakes to pay the amount due within a certain period (even divided the same) and, in the event that it fails as agreed, put the matter in the hands of a lawyer to defend the community and initiate judicial proceedings.
