El pasado mes de febrero el Presidente de mi Comunidad instaló una cámara de grabación de imágenes en el portal como medida de seguridad del edificio, pero ello fue llevado a cabo sin ningún tipo de consulta o autorización del resto de vecinos, ¿es esta instalación legal?

Esta instalación no se ha llevado a cabo de manera correcta y acorde a lo previsto en la Ley de Propiedad Horizontal, pues para la instalación de cámaras de video vigilancia es imprescindible la previa autorización y consentimiento de la Comunidad, necesitando para su establecimiento el voto favorable de las tres quintas partes del total de los propietarios, que a su vez representen las tres quintas partes de las cuotas de participación.
Además hay que tener en cuenta lo previsto por la Ley Orgánica de Protección de Datos de Carácter Personal al exigir el consentimiento del afectado para tratar sus datos personales, lo que tampoco se ha respetado.
Por ello, será conveniente convocar una Junta en donde se decida sobre dicha instalación y en el caso de que no se obtenga un resultado favorable se dará un plazo al Presidente para que retire la cámara, advirtiéndole que de no hacerlo se procederá a ejercer contra él las correspondientes acciones judiciales.

This installation has been done against the Horizontal property law, because for the installation of video cameras surveillance the authorization and consent of the community is essential, they need the vote of three-fifths of the total number of owners, which in turn represent three-fifths of the participation fees for its establishment
Moreover must be taken into account as provided for by the organic law of protection of data the Personal nature by requiring the consent of the affected to treat their personal data, which has not been respected
Therefore, it would be appropriate to convene a meeting where you all decide on that facility and in the case that a favorable outcome is obtained the President will be notified of the timeline to remove the Chamber, warning that not doing so the community will initiate the relevant legal actions.
