Buenos días. He recibido la convocatoria para la próxima Junta de la Comunidad de Propietarios y he observado que no se ha incluido un asunto que solicité personalmente que se incluyera. Soy conocedor que es obligatorio, así que se lo he presentado por escrito al presidente, solicitando me firme el recibí pero no ha accedido a ello, indicándome que no me preocupe, que del punto en cuestión se hablará más adelante, pero no me ha especificado cuándo. ¿Qué pensáis que puedo hacer?

Como propietario estás en tu derecho de solicitar que se trate un punto de tu interés en la próxima Junta de tu Comunidad. Además, lo has hecho por escrito dirigiéndote al Presidente de la Comunidad, que es el procedimiento recogido en el artículo 16.2 de la Ley de Propiedad Horizontal. Como éste no te ha querido firmar el escrito, puedes optar por varias opciones (por ejemplo dirigirte al vicepresidente o a los vocales de la Junta Rectora del edificio para que conste tu solicitud; enviar un e-mail al presidente con tu solicitud de que se incluya el punto y llevar el e-mail impreso el día de la Junta; enviarle una carta certificada y guardarte el acuse de recibo, etc…). El objetivo es que puedas justificar que has realizado la solicitud en tiempo y forma como marca la Ley y, por tanto, se debe de tratar el punto que indicas.
Si, finalmente, el Presidente no accede a la solicitud, y en tu Comunidad tenéis Administrador de Fincas, indícale que has notificado al presidente y por tanto el punto se debe tratar en la próxima Junta, aunque no figure entre los puntos de la convocatoria.

As owner, your right is to request to take to the meeting any point of interest for your community. In addition, you’ve done in writing to the President of the community, which is the procedure contained in article 16.2 of the Horizontal property law. As he did not want to sign the document, you can choose several options (for example go to the Vice President or the members of the Governing Board of the building so that your application; send an e-mail to the President with your application to include the point and bring the printed e-mail the day of the Board; send a certified letter and save you the acknowledgement of receipt (, etc…). The goal is that you can justify that you have made the request in time and how the law and, therefore, must raise the point that indicates.
If, finally, the President does not access the application, and in your community there is an administrator, indicate him that you’ve notified the President and therefore, tht ítem must be discussed
