Buenos días. Les escribo porque dispongo de un bajo comercial en un edificio al norte de Murcia, donde tengo ubicado mi negocio (una tienda de compra-venta de muebles), en el cual van a colocar un andamio para restaurar la fachada. Dicho andamio va a tapar todo mi escaparate y el rótulo que lo anuncia, así como va a dificultar la entrada de posibles clientes al mismo, por lo que va a entorpecer muchísimo la captación de clientes. Me comentan que las obras pueden durar hasta el final del verano, por lo que no quiero ni pensar las pérdidas que ello puede ocasionar a mi negocio. Por ello, me gustaría saber si tengo derecho a oponerme a la realización de las obras mencionadas o si puedo tomar acciones legales.

Buenos días. Comprendemos su preocupación pero entendemos que la restauración que usted menciona será algo positivo para toda la Comunidad (incluido los bajos comerciales). Dado que una obra así requiere de la aprobación en Junta, lo normal es que esa obra esté autorizada por la mayoría de los vecinos. Por tanto, si para llevarla a cabo es necesario instalar ese andamio, hemos de decirle que la Comunidad tiene todo el derecho a colocarlo (aunque ello perjudique a alguno de los vecinos, como por ejemplo usted). En cuanto a su pregunta, usted, por Ley (LPH, art. 9.1.c), está obligado a consentir la reparación.
No obstante, en dicho artículo se recoge la posibilidad que los perjudicados por las obras tienen derecho a que la Comunidad les abone una indemnización por los daños y perjuicios (por ejemplo por la reducción de ingresos). En su caso concreto, como el andamio únicamente le impide visibilidad y acceso, pero no va a tener que cerrar su negocio, lo que le recomendamos es que intente llegar a un acuerdo amistoso con la Comunidad, por ejemplo, solicitando que coloquen un cartel provisional y visible para todo el mundo. En caso de que la Comunidad se oponga y usted sufra pérdidas en su negocio que tengan relación con la obra que se está ejecutando, puede contactar con un abogado para valorar iniciar acciones civiles.[:en][idz_note color=”blue” class=””]

The scaffolding will cover my window and the advertising sign, as it will hinder the entry of potential customers to it, so that’s going to hinder a lot customer acquisition. They tell me that works may last up to the end of the summer, for what I do not want or think the losses which may result to my business. Good morning. We understand your concern, but we understand that the restoration that you mention will be something positive for the Community (including the commercial low). Given that such work requires Board approval, it is normal that this work is authorised by the majority of residents. Therefore, if to carry out it is necessary to install the scaffold, we must say that the community has every right to place it (even if it harms some of the neighbours, as for example you). As for your question, you, by law (LPH, art. 9.1. c), is obliged to allow repair.
However, this article includes the possibility that those workers affected by the works are entitled receive a compensation for the damages (e.g. reduction of income). In your specific case, as the scaffolding only prevents you from visibility and access, but will not have to close your business, we recommend try to reach a friendly agreement with the community, for example, requesting that they placed a provisional and visible sign for the whole world.
