Buenos días. En la Comunidad en la que resido hace 2 años que no se hacen reuniones (ordinarias y/o extraordinarias) y por ende no tenemos conocimiento del estado de cuentas de la comunidad así como de los problemas que hay. Actualmente ostento el cargo de vocal en la Junta y, dadas las circunstancias, me gustaría saber si puedo dimitir al no estar conforme con la gestión que se está llevando a cabo.

Buenos días. Hemos de comunicarle que el cargo de vocal, así como el del resto de los cargos son anuales. Al igual que ello, también es obligatoria la presentación de cuentas así como la elección de nuevos cargos.
Dada su situación, debería exigir al presidente que convoque junta de propietarios para la elección de nuevos cargos(es su obligación y tiene responsabilidad legal por no hacerlo). En esa junta con que no se presente a vocal su cargo se extinguirá, no es necesario dimitir.
Lo que no pueden estar es 2 años sin saber la situación de la comunidad puesto que se pueden encontrar problemas graves y pudiera ser que difícilmente salvables.[:en][idz_note color=”blue” class=””]

It makes thing 2 years that are not made (ordinary or extraordinary) meetings in the community in which I live and therefore have no knowledge of the situation of tha accounts in the community as well as the problems that exist. Good morning. We have to inform you that the position of vocal, as well as the rest of the charges are annual. Like this, the presentation of accounts as well as the election of new charges is obligatory.
Given his situation, you should require the President to convene meeting of owners for the election of new charges (this is his duty, otherwise he is in legal responsibilities). In that meeting, if you just do not stand as vocal, you will not be re elected, you don’t need to resign.
What cannot be is 2 years without knowing the situation of the community since serious problems can be found and could be far of solution.[:]
