Buenas tardes. ¿ Se computarán como votos favorables los de aquellos propietarios ausentes? Mi vecino de al lado y yo no pudimos asistir a la última Junta en donde se acordaron decisiones que necesitaban el voto favorable por unanimidad. Pero, ¿es posible llegar a la unanimidad para la adopción de un acuerdo sin estar presente en Junta?

Es normal pensar que si en la Junta no se encuentran todos los propietarios para votar a favor o en contra de un acuerdo, no puede existir unanimidad, pero no es así de literal. Hay que tener en cuenta lo que prevé la ley en cuanto a que un propietario puede asistir mediante representante legal bastando para ello un escrito firmado por el propietario, y por otro lado prevé la ley que se computarán como votos favorables los de aquellos propietarios ausentes, debidamente citados, quienes una vez informados del acuerdo adoptado en Junta, no manifiesten su discrepancia en el plazo de 30 días naturales desde la notificación del mismo. Quizás ustedes se encuentren en este último caso, siendo que al no haber manifestado nada al respecto del acuerdo adoptado en Junta, se haya computado como favorable a la mayoría alcanzada, llegándose a esa unanimidad.[:en][idz_note color=”blue” class=””]
Good afternoon. Is ok to record as favourable vote those of absent owners? My next door´s neighbour, and I could not attend the last meeting where agreed decisions needing unanimous vote. But, it is possible to reach unanimity for the adoption of an agreement without being attending the 100% of the owners?

It is normal to think that if not all owners are attending to vote for or against an agreement, there can be no unanimity, but it is not how it works. You must bear in mind what is in the law about this which provides that a landlord can assist through legal representative sufficing to do so a writing signed by the owner, and on the other hand the law provides to be computed as favourable votes of those absent owners, properly summoned, who once informed of the agreement adopted on board, do not manifest their disagreement within the period of 30 calendar days.. Perhaps you are in the latter case, to not have said anything about of the agreement adopted on board, has been computed as favourable reached by the majority, reaching the unanimity[:]
