Buenas tardes. Les escribo porque desde la última Junta de Propietarios que se celebró en mi Comunidad de Propietarios (resido en Torrevieja), se decidió colocar un tablón de anuncios en el que poner información relativa a la gestión y el día a día del edificio. El problema es que ese tablón de anuncios dispone de un marco con llave, que sólo la tienen el Presidente y el Administrador y, por tanto, los vecinos no podemos poner ninguna información sin que antes pase el filtro por parte de las personas que sí disponen de ella. Me pregunto si tanto el Presidente como el Administrador tienen derecho a no facilitar una copia de la llave al resto de vecinos.

Buenas tardes. Ante la duda que nos plantea hemos de decirle que el tablón de anuncios se considera un elemento común y, como tal, la Comunidad puede decidir el uso que se le da al mismo. Si en principio sólo la tienen el Presidente y el Administrador, entendemos que es porque así se decidió en su día, pero si usted quiere disponer de llave y modificar el funcionamiento, propongalo en la próxima Junta (indique al Presidente que lo incluya en el Orden del Día) y sometanlo a votación
No obstante lo anterior, creemos que el funcionamiento del tablón de anuncios que han establecido en su Comunidad es el adecuado, pues la LPH (en su artículo 9 apartado h) lo considera como el medio para poder realizar notificaciones a los propietarios en caso de poder realizar por la vía normal y, esas comunicaciones, normalmente han de ser realizadas bien por el Presidente bien por el Administrador. En caso contrario, los vecinos podrían darle un mal uso, colgando, por ejemplo, información personal de otro/s vecino/s.[:en][idz_note color=”blue” class=””]

I am writing because since the last Board of proprietors, which was held in my community of owners (I live in Torrevieja), it was decided to place a bulletin board to receive information concerning the management and the daily life of the building. The problem is that that noticeboard has a framework with key, which only have the President and administrator and, therefore, the neighbours can put any information without that before it passes the filter by the people who do have it. I wonder if both the President and the administrator have the right not to provide a copy of the key to the rest of inhabitants.
