Buenos días. Vivo en una comunidad en la que hace unos días se procedió a la reparación del tejado ya que se estaban inundando dos viviendas como consecuencia de los daños que sufría el mismo. El caso es que hay unos propietarios, a los que se les comunicó verbalmente la necesidad de llevar a cabo dicha reparación, que se niegan a pagar la reparación alegando que la comunidad no se encuentra constituida formalmente y que por tanto no están obligados a pagar su cuota correspondiente. ¿Están en lo cierto?

Buenos días. Dichos propietarios están equivocados, ya que aunque la Comunidad no esté constituida formalmente, existe y, como tal, se rige por la Ley de Propiedad Horizontal.
Así según la LPH, existe la obligación de mantener el edificio en las adecuadas condiciones de conservación, seguridad, habitabilidad, etc. Y, por la misma ley, también existe la obligación de contribuir a los gastos de acuerdo al sistema establecido (según coeficientes, por normal general, o a partes iguales, en algunas Comunidades).

Good morning. These owners are wrong, since even if the community is not formally constituted, it exists and, as such, is governed by the law of Horizontal property.
