Buenos días. Hace dos meses adquirí una vivienda de la que ahora, la Comunidad, me reclama el pago por unas obras en los elementos comunes del edificio que se estaban realizando antes de la compra, pero me he negado a pagar tales gastos. ¿Estoy obligado a pagar esto?

Lo que ha ocurrido aquí, según lo que nos expone, es que el anterior propietario no le comunicó la existencia de este gasto que hubiera sido una carga en la venta, y por tanto puede existir un vicio del que es responsable el vendedor. Sin embargo, usted sí deberá pagar este gasto, pues la Comunidad está legitimada para reclamar el pago proporcional de dichos gastos a quien es el actual dueño en el momento de terminación de la obra y liquidación del precio de la misma, por lo que le aconsejo que haga frente a este gasto y paralelamente reclame al anterior propietario dicha cuantía.

What has happened here, as what exposes us, is that the previous owner did not communicate the existence of this expenditure which would have been a burden on the sale, and there may therefore be a Vice for which the seller is responsible. However, you do pay this expenditure, as the community is entitled to claim the proportional payment of those expenses to who is the current owner at the time of completion of the work and payment of the price of the same what advise you to meet this expenditure and at the same time claim the previous owner such claims.
