Buenos días. Mi marido ha heredado junto con sus dos hermanos una vivienda. Resulta que dicha vivienda viene adeudando a la Comunidad 3.300 euros correspondientes a los gastos comunitarios que su familiar ahora fallecido, dejó de pagar. Ahora la Comunidad reclama exclusivamente a mi marido para que pague el total de la deuda, pero ¿tiene él la obligación de pagar el total o debe pagar la parte que le corresponde, lo que serían 1.100 euros?

Tal y como nos explica, los tres hermanos han heredado una vivienda en proindiviso y como tal existe una responsabilidad solidaria de los tres como copropietarios con la Comunidad. Ello quiere decir que la Comunidad sí puede reclamar la totalidad a su marido, pues precisamente por existir esta responsabilidad solidaria cualquiera de ellos queda obligado al pago del total adeudado. Eso sí, posteriormente, en caso de que su marido abonase el total, podrá él repercutir contra sus hermanos copropietarios el pago proporcional del importe pagado a la Comunidad.

According to you, your husband and his two brothers have inherited the property in pro indiviso so the three owners are responsible of the property jointly liable regarding the community. This means that the community can go directly against any of the three owners. Now, once your husband pays the debt, he can claim the refund of the proportional part to the other two owners.
