Hace un año se aprobó una derrama para la instalación de un ascensor, para lo que todos los vecinos hicimos una importante aportación. Finalmente la instalación no se pudo llevar a cabo por un problema técnico del edificio, pero la Comunidad no devolvió las aportaciones realizadas, sino que el dinero ha sido guardado para futuras reformas. Pero, ¿puedo solicitar que se me devuelva mi aportación?

Lo que ha hecho su Comunidad es aportar esas cantidades al fondo de reserva, pero aunque los propietarios deben contribuir a la dotación de este fondo destinado a atender las obras de conservación y reparación del inmueble, lo cierto y verdad es que la aportación que usted realizó no ha sido destinada al fin para el que hizo el pago, y por tanto, está en su derecho de solicitar que le sea devuelto el importe, al no estar de acuerdo con que el dinero quede supeditado a obras futuras que aún ni han sido aprobadas por la Comunidad. Salvo que fuera acordado por Asamblea de Vecinos el destinar el fondo a esa partida en concreto[:en][idz_note color=”blue” class=””]
A year ago, the community approved an extra payment for the installation of an elevator, so all the neighbours made an important contribution. Finally the installation could not be carried out due a technical problem with the building, but the community did not refund the contributions, but that money has been saved for future repairs. Can I apply for my contribution to be refunded to me?

What the community did was to provide those amounts to the reserve fund, but although the owners must contribute to the endowment of this Fund to attend the works of maintenance and repair of the property, certainly, the contribution made by you has not been destined to the purpose for which you made the payment, and therefore you are entitled to require that the amount is returned if you do not agree with that decision of keeping the money as contingent on future works that have still not been approved by the community. Unless that the community agreed at the AGM to include that fund in that budget expenditure.[:]
