Buenos días. Les escribo porque acabamos de adquirir una vivienda situada en un bajo de un edificio de Murcia, en la cual quiero instalar un aparato de aire acondicionado pero no dispongo de ningún lugar donde poder colocar el compresor, por lo cual necesito saber si puedo colocarlo en la fachada del edificio y qué trámites he de hacer para obtener la autorización de la Comunidad de Propietarios.

Buenos días. Como bien dice, dadas las condiciones que nos plantea, lo primero que ha de hacer es obtener la autorización de la Comunidad de Propietarios, pues si ha de colocar el compresor en la fachada del edificio, se consideraría que está alterando la estética del mismo y para ello necesitaría el voto favorables de las 3/5 partes de los vecinos y las correspondientes cuotas de participación (salvo que esté prohibido expresamente por los Estatutos, en cuyo caso deberían modificar los mismos y sí que se necesitaría unanimidad).
Para ello, necesita que se convoque una Junta extraordinaria, por lo que le aconsejamos hable con el Presidente exponiéndole la situación para que incluya su punto en el orden del día. Entendemos que no tendrá ningún problema pero, para el caso de que se negara, pueden tratar de convocarla ustedes para lo cual necesita el apoyo del 25% de propietarios y/o cuotas de participación. A la hora de realizar la votación, le sería muy útil saber si existen otros compresores en la fachada, pues ello le facilitará bastante obtener un resultado favorable.[:en][idz_note color=”blue” class=””]

As you said, given the conditions that you explain, the first thing to do is obtaining the authorization of the owners, since if it is to locate compressor in the facade of the building, would be considered that it is altering the aesthetics of the same and for this purpose It would require the favourable vote of the 3/5 parts of neighbours and relevant participation fees (unless expressly prohibited by the statutes, in which case should modify them and that unanimity would be required).
To do this, you need an extraordinary meeting to be convened, so we recommend you to talk with the President exposing the situation so that this point is included in the agenda. We understand that you won’t have any problem, but in the case that is refused, may try to convene it by yourself, for which you need the support of 25% of owners or participation fees.
